This outlines what we expect of an EbookOcean.com Author across our platforms, including their agreement with customers and with us (EbookOcean).
In order to provide the best experience and products to our global customer base, we have expectations of you, our authors and how you operate using our platforms.
We want to ensure fair and equal opportunity for all community members and ensure that there is always a high value offering for our customers. This means that when they land on EbookOcean, your item(s) have the best chance for success in selling.
As we work on continuously managing our platforms to equip Authors to sell more items that customers want, we need you to do your part in ensuring only the best quality items are available on EbookOcean.

Authors and Customers
When a customer purchases your item, they have a right to expect that:
The quality will be acceptable.
The item is described accurately and honestly.
Any promises made by the author will be kept and honoured.
All members of the EbookOcean Author Community are expected to be fair and truthful in what they say and do. All members should keep the community’s best interests at heart.
Everyone is open, straightforward, trustworthy and plays by the same rules. The information provided is clear, accurate and easy to understand.
There are consumer laws in many countries giving customers protection, that the items quality will be acceptable and works as promised. EbookOcean customers will base their buying decision on the information provided. If the information is not accurate, then not only is a customer potentially misled, other Authors may miss out on a potential sale.
When a customer asks a pre-sales question, it’s important the information provided is clear, accurate and easy to understand. A customer can then correctly determine if the item is suitable for their project.
If a customer is misled by the item information, they may be entitled to a refund which EbookOcean Market staff will fairly assess.
Misleading a customer may include:
Claiming the item has a feature or function that it does not have.
Advertising the item is supported, when it is not.
Please Note: If you do provide support, you’ll need to be prepared to;
Answer technical questions about features and functionality.
Help with third-party assets sold with the item (eg. bundled plugins).
Assist in fixing issues.
You are not required to install or customize your items or assist with hosting or third party software. Set expectations clearly in your item description for your customers on what your average response time is, for example; I will aim to respond to all requests within 48 hours. Please refer to Item Support Best Practices and the Item Support Policy if you are planning to offer Support.
When uploading your items to EbookOcean, please ensure your item(s):
Works as described and matches descriptions given on the item page (or elsewhere).
Includes ALL the features and functionality as advertised.
Matches the demo or live preview.
Comes with full title and ownership (or properly licensed assets).
Please Note: It’s the Author’s responsibility (yours!) to ensure any applicable consumer laws are followed for the customer purchasing your item(s). This includes all claims made about the item(s) on the item page, on EbookOcean platforms, EbookOcean forums, on social media or any other sites too.
When you sign up to create an account with EbookOcean, you agree to our Author Terms, which outline expectations of you, as an Author and how you operate on our platforms.
This means for each of your items, you warrant (promise) to us that:
The Item conforms to the Content Guidelines or any Supporting Materials;
The Item is of acceptable quality and fit for the purpose for which it is ‘sold’;
The Item matches the description given by you;
You have the rights necessary to grant us the rights set out in clauses 5 and 6 of the Author Agreement;
Nobody else’s intellectual property rights will be infringed by our use of the Item, our licensing of the Item to subscribers, or subscribers using the Item in accordance with the terms of the EbookOcean Elements License (as amended from time to time);
The Item complies with our Acceptable Use Policy;
The Item and its description do not violate any applicable law or regulation (including those governing export control, consumer protection, unfair competition, criminal law, pornography, anti-discrimination, trade practices or fair trading);
You will process a subscriber’s information in accordance with applicable privacy law and data protection regulations;
If the Item preview contains watermarked previews sourced through another EbookOcean Company site, you must ensure the following: (i) the watermark must remain on the watermarked preview; (ii) the author and name of the watermarked preview must appear in your Item description; and (iii) the watermarked preview must not be included in your Item file(s) available for download; and
Where relevant, you have obtained a valid and binding model or property release for any Items requiring such a release and you must: Follow the Content Guidelines or any process set out in the Supporting Materials for capturing model and property releases;
Retain copies of all releases and provide those copies to us upon request;
Provide a privacy notice, making the model aware of their personal information that you will receive and how you will handle that information;
Obtain the model’s permission to use their personal information;
Use the personal information only for the limited purposes for which the model gave permission; and
Meet any privacy and spam law requirements that apply to you.

The Review Process
As an author at EbookOcean, you have the opportunity to create and license your original content to our global customer base. This means that there are legal responsibilities associated with licensing items through EbookOcean platforms that you need to adhere to, so we can ensure that we keep our community safe and respectful.
It is your responsibility to ensure you carry out the correct legal arrangements and consents for your projects in order to protect both yourself and others, including following any applicable laws, tax & financial requirements, our user terms and author agreement, along with any guidelines or policies set.
Respect and protection for intellectual property (IP) and the work of others is at the core of these responsibilities. Intellectual property is a complex area of the law and covers a whole range of things like copyright, trademarks, design and patents, among others.
There are many types of IP but as an author, there are some specific areas that would be especially relevant to your items and the assets used within your items, so please review the articles linked below:
Copyright: This gives the author or creator of an original work the exclusive right to do certain things with that original work. They have the right to choose if anyone else can use, adapt or resell their work and have the right to be credited for that work. This means that you need to ensure that your item, and anything included within it, is not taken from elsewhere unless you have an appropriate license to do so. This includes third party assets like images or fonts that are included within your item or it’s preview and description. You must make sure that you have properly licensed all assets you are using within your individual item(s). Model and Property Releases: This is a legal document signed by the person (model release) or the property owner (property release) of a photograph or video or other image, granting permission to use or publish the subject in one form or another. When uploading footage or photographs that depict recognizable human beings or identifiable buildings, you must obtain and attach a signed release form (see where you attach it in the Upload Instructions). You must also retain a copy of a photo ID for the model so that the signature on the model release form can be verified. Trademarks & Real-World Products: A trademark is a word, phrase, symbol, and/or design that is legally registered or established by use as representing a company or product. A real world product is a reference to a real-world thing, like a car or a tablet or even a shoe. You may want to use one or both in your items, however this can be a complex area of intellectual property and there are different rules for assets in item previews (these assets don’t get distributed to your customers, they are for preview purposes only) and assets in item download (refers to assets that are included in the download of the file).
You can use trademarked words in your item previews if they are describing factually what your item is, or how a customer could use your item. Similarly, a logo in your item preview could show what platforms your item works with.
In most cases, a real world product cannot be the focus of an item. This is because EbookOcean does not offer editorial licenses, and you may be infringing the intellectual property of someone else.

When you create and upload your work to our EbookOcean sites, you (as the author) hold the responsibility of the item and any assets included.
EbookOcean’s role is as the service provider of the platform. The items on EbookOcean Market are uploaded at the direction of you, the author. We provide the platform services; we do not take ownership of the items.
We may check content submitted for quality purposes and while doing so, identify potential violations of our terms or the rights of others. In this case, we will contact you to let you know that there is an issue with your item, but it is your responsibility to ensure your items respect the EbookOcean Terms and the intellectual property rights of others.
On the occasion that we do receive complaints about unauthorised use of content within an author’s item, depending on the circumstances and who has made the claim, we can apply the DMCA law in line with the DMCA process.
We do our best to ensure a safe, fair and equitable environment for customers and authors. Our Integrity team may contact you in the event there is a complaint about your item or account, or if we identify that you have breached any of the EbookOcean Terms and policies in some way.
We will always try to work with everyone fairly and in the spirit of our community. Unfortunately, we can't help by giving you legal advice as we are a service provider, not a court of law. It’s for this reason that you need to understand your responsibilities when selling through EbookOcean.
In accordance with the author terms, you have the responsibility to ensure that your items are clear of any copyright or other intellectual property issues, from start to finish.
